Formula
The lesser-of structure means the effective rate rises from zero at the threshold to the full-price rate at the crossover, and is then permanently capped. It is progressive only across a narrow band.
Worked Example
- Establish the taxable value. Purchase price plus any improvements, accessories and delivery charges incurred before delivery. This is where most disputes arise.
- Compute both formulas. 10% of $150,000 is $15,000. 20% of the $50,000 above the threshold is $10,000.
- Take the lesser. $10,000.00 is payable — an effective 6.67%. Below the crossover the excess rule always gives the smaller figure.
- Find the crossover. The two formulas meet at $200,000, where both give $20,000. Above that the 10% ceiling binds and the effective rate never rises again.
- Add sales tax on top. The luxury tax sits inside the sales tax base, so 5% GST on price plus luxury tax is $8,000.00 — including $500.00 of tax charged on the tax.
The accessories timing trap is the planning point. A $98,000 vehicle with $8,000 of accessories fitted before delivery has a taxable value of $106,000 and owes $1,200.00. The identical accessories fitted after delivery leave the value at $98,000 — below the threshold — and the tax is nil. Timing alone is worth the entire liability when the base price sits just under the line.

Canada's Select Luxury Items Tax Act imposes tax at the lesser of a percentage of the full taxable value or a higher percentage of the amount by which that value exceeds a price threshold — for vehicles, 10% of the full price or 20% of the excess over $100,000. The lesser-of structure produces an effective rate that climbs from zero at the threshold to the full-price rate at the crossover, computed as the excess rate multiplied by the threshold divided by the difference between the two rates, which for the standard parameters is exactly $200,000. Above that point the effective rate is permanently capped. Taxable value includes improvements, additions, delivery charges and other taxes incurred before delivery, but items supplied after the buyer takes delivery are outside it, and modifications within twelve months may require self-assessment. Subject vehicles are those seating ten or fewer, weighing 3,856 kg or less and manufactured after 2018; ambulances, police vehicles, motor homes and cargo-only vehicles are excluded, and zero-emission vehicles are covered on the same terms. The tax is generally inside the GST/HST base, producing tax on tax. Aircraft above $100,000 and vessels above $250,000 left the regime on 5 November 2025 under CRA Notice LTN5, formally legislated by Bill C-15, SC 2026 c.3, with Royal Assent on 26 March 2026; the repeal is not retroactive and does not refund tax already paid.
