The taxable share is the whole difficulty. It is not a rate question but a classification question, and the same product can be fully taxable, partly taxable or exempt depending on the state and the delivery method.

Worked Example

  1. Classify the product in this state. SaaS, downloaded software, streaming and ebooks are four separate categories in most statutes, and a state can tax one and exempt another.
  2. Apply the taxable share. New York taxes SaaS in full. Texas taxes 20% of it, treating SaaS as a data processing service. California exempts it entirely.
  3. Apply the combined rate. On $333,333.33 of revenue at 8.53% fully taxable, that is $28,433.33. The same revenue in Texas yields $5,466.67 because only a fifth is in the base.
  4. Check the delivery method. California exempts cloud SaaS but taxes the identical software downloaded. On this revenue the delivery method alone is worth $29,500.00.
  5. Size the exposure if you got it wrong. Uncollected sales tax is the seller's liability. Three years of under-collection in two states is $170,600.00, or $213,250.00 once penalty and interest are added.

The Texas 20% rule deserves attention because it is so easily missed. Texas classifies SaaS as a data processing service and taxes only 20% of the charge, giving an effective rate of 1.64% rather than 8.20%. A seller applying the headline rate over-collects by $21,866.67 on $333,333 of revenue — and over-collected tax must still be remitted or refunded to customers, not kept.

There is no federal sales tax and no federal definition of a digital product, so taxability is determined state by state and category by category. More than 30 states now tax at least one class of digital product, and streaming is taxed more broadly than any other category. SaaS is taxable in over 20 states including Texas, New York, Pennsylvania and Washington, and exempt in California, Florida and Michigan among others. Texas classifies SaaS as a data processing service and taxes 20% of the charge, producing an effective rate of one fifth of the headline figure. Several states distinguish delivery method: California exempts electronically accessed software but taxes prewritten software delivered by download, and other states apply a permanent-use test under which temporary access is exempt but a permanent right is taxable. This engine takes the taxable share and combined rate as user inputs because the matrix changes by legislative session — Louisiana expanded to most digital products in 2025, Maine added digital audio and audiovisual services on 1 January 2026, and Maryland applies a separate 3% levy to certain IT and software publishing services. Computation runs in IEEE-754 double precision at full internal precision; rounding to two decimal places occurs strictly at the display layer, so no cumulative drift enters the result. All monetary outputs use accounting presentation — grouped thousands, two decimals, negatives in parentheses — so figures can be transcribed directly into a model or working paper. Division-by-zero and out-of-domain inputs return an em-dash rather than a misleading number.
