The Practical Position

What this result does not account for

  • Assumes gifts of present interests; transfers into most trusts need Crummey withdrawal rights to qualify for the annual exclusion.
  • Direct tuition and medical payments are unlimited and excluded entirely — do not enter them here.
  • Only Connecticut levies a state gift tax; state rules are not modelled.

In short: A $100,000 gift to one person, split with a spouse, uses $38,000 of annual exclusions and leaves a $62,000 taxable gift. The tax due is $0.00: it simply reduces a $30,000,000 lifetime exemption by 0.2067%. Spread over three years the gift disappears entirely and no return is needed.

Formula

Capacity = $19,000 × Recipients × (2 if splitting)
Taxable gift = max(0, Gift − Capacity)
Tax = max(0, Taxable gift − Exemption remaining) × 40%

The annual exclusion is per recipient per year and resets every January. The lifetime exemption is $15,000,000 per donor in 2026, doubled when a married couple elects to split gifts. Only amounts beyond the lifetime exemption produce cash tax.

Worked Example

  1. Count your exclusions. $19,000 per recipient, doubled to $38,000 when a spouse consents to split. One recipient gives $38,000 of capacity this year.
  2. Subtract them from the gift. $100,000 less $38,000 leaves a $62,000 taxable gift.
  3. Charge it to the lifetime exemption. $62,000 comes off a $30,000,000 split exemption — 0.2067% of it. Cash tax due is $0.00.
  4. File the return anyway. Form 709 is required to report the taxable gift and to make the splitting election, even though nothing is payable.
  5. Or restructure and skip it. Spread over three years at $38,000 a year, or give to a child and their spouse at $76,000 a year, and the gift is fully excluded with no return at all.

This is the calculation almost everyone gets backwards. A $62,000 taxable gift sounds expensive; the tax is zero. What the gift actually costs is a small slice of an exemption most estates will never exhaust, plus one form.

Strengths & Limits Of This Model

Where this engine is strong

  • Separates the filing requirement from the tax bill — the distinction that actually matters.
  • Shows how staging a gift across years or recipients removes the return entirely.
  • Models the gift-splitting election, including that it triggers a Form 709 of its own.

Where it stops

  • Cannot assess whether a transfer is a completed gift — that is a legal question.
  • Does not model generation-skipping transfers to grandchildren.
  • Valuation of non-cash gifts is the hard part and sits outside this engine.

Practical Use Cases

Helping a child with a house deposit

A $100,000 contribution is the classic case. Split with a spouse and staged across two calendar years, it can be delivered with no return and no exemption used.

Funding education without using exclusions

Tuition paid directly to the institution is unlimited and does not count as a gift at all. The same applies to medical bills paid directly to the provider.

Front-loading a 529 plan

A five-year election lets you contribute five annual exclusions at once, $95,000 per donor, and treat it as spread across five years.

Reducing a taxable estate

For estates above $15,000,000, lifetime gifting moves future appreciation out of the estate — model the effect with the Estate Tax Calculator.

Methodology & Editorial Standards

Figures are 2026: a $19,000 annual exclusion per recipient, unchanged from 2025, and a $15,000,000 lifetime exemption per donor made permanent by the One Big Beautiful Bill Act. The gift and estate exemptions are a single unified credit, so lifetime gifts reduce the exemption available at death. The engine assumes gifts of present interests, which is what the annual exclusion requires; gifts into most trusts need Crummey withdrawal rights to qualify. Direct payments of tuition and medical expenses are unlimited and excluded from the gift calculation entirely, as are transfers to a US citizen spouse and to qualifying charities. Gifts to a non-citizen spouse have a separate $194,000 annual limit in 2026. State gift tax is not modelled because only Connecticut imposes one. The engine implements the standard published formula for this calculation. Inputs are validated for domain and sign before evaluation, and any undefined case returns an em-dash rather than a spurious value.

Computation runs in IEEE-754 double precision at full internal precision; rounding to two decimal places occurs strictly at the display layer, so no cumulative drift enters the result. All monetary outputs use accounting presentation — grouped thousands, two decimals, negatives in parentheses — so figures can be transcribed directly into a model or working paper. Division-by-zero and out-of-domain inputs return an em-dash rather than a misleading number.

This engine was reconciled against an independent reference implementation and hand-verified for the worked example above before release. Our full five-stage review process is published on the About Us page.

Gift Tax Calculator — 20 Expert FAQs

20 analyst-written answers to the questions practitioners actually ask — optimised for voice and answer-engine retrieval.

How much money can I give someone without paying tax?

$19,000 per recipient in 2026 with no return and no exemption used. Beyond that you still pay nothing until cumulative taxable gifts exceed $15,000,000 — you simply file a form.

Does the recipient pay tax on a gift?

No. Gift tax is imposed on the donor, never the recipient. Money received as a gift is not income and is not reported on the recipient's return at all.

Do I owe gift tax on $100,000?

Almost certainly not. Split with a spouse, $38,000 is excluded and the remaining $62,000 reduces your lifetime exemption. The cash tax due is $0.00.

What is gift splitting?

A married couple can treat a gift made by one spouse as made half by each, doubling the annual exclusion to $38,000 per recipient. It requires both spouses to consent on Form 709.

When do I have to file Form 709?

Whenever a gift to any one person exceeds the annual exclusion, or when you elect to split gifts with a spouse. The return is due with your income tax return the following April.

What happens if I never file Form 709?

The statute of limitations never starts running on an unreported gift, so the IRS can revisit it indefinitely — usually at the worst possible moment, when the estate is being settled.

Does paying someone's tuition count as a gift?

Not if you pay the institution directly. Direct tuition and direct medical payments are unlimited exclusions on top of the $19,000, and no return is required.

Can I give $19,000 to as many people as I like?

Yes. The exclusion is per recipient with no cap on the number of recipients. Ten recipients means $190,000 a year, or $380,000 for a couple electing to split.

Does the annual exclusion carry forward?

No. It is strictly use-it-or-lose-it each calendar year, which is why gifts are so often staged across a 31 December boundary.

How do gifts affect my estate tax exemption?

They are a single unified figure. Every dollar of taxable gift reduces the exemption available at death, which is why the $62,000 here matters even though no tax is due.

Is it better to gift now or leave assets at death?

Below the exemption, leaving them is usually better because heirs receive a stepped-up basis that erases unrealised capital gain. Above it, gifting removes future appreciation from the estate.

Do I pay gift tax on a loan to family?

A genuine loan is not a gift, but it must carry at least the applicable federal rate of interest and be documented. Forgiven interest or principal becomes a gift in the year it is forgiven.

Are gifts to my spouse taxable?

Transfers to a US citizen spouse are unlimited and entirely free of gift tax. A non-citizen spouse has a separate annual limit, $194,000 in 2026.

What is the 5-year election for a 529 plan?

It lets you contribute five years of annual exclusions at once — $95,000 per donor — and elect to treat the gift as spread evenly across five calendar years.

What is the actual gift tax rate?

40%, the same as the estate tax, but it applies only to cumulative taxable gifts above $15,000,000. Very few donors ever reach it.

Is this gift tax calculator free to use?

Yes. It is free, requires no account, and has no usage limits. ApexConverter is funded by contextual advertising, never by selling user data.

Is my data sent to a server?

No. The engine runs as Vanilla JavaScript inside your browser under our Zero-Server Client-Side Execution model. Your figures are computed locally and are never transmitted, logged, or stored.

How accurate is this calculator?

It applies the standard closed-form formula in IEEE-754 double precision, rounding only at the display layer. The engine is reconciled against an independent reference implementation before release.

Does it work on mobile?

Yes. The interface is mobile-first with numeric keypad hints and is tested down to a 320-pixel viewport with no horizontal scrolling.

Can I use it offline?

Largely, yes. Because computation is client-side, the page continues to calculate without a network connection once it has loaded.
